Terms of Service

1. Acceptance of Terms

By purchasing, downloading, installing, or using the MadBot WordPress plugin ("Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms constitute a legal agreement between you ("Customer", "you", or "your") and TheMadRobot ("Company", "we", "us", or "our").

You represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. License Grant

Upon purchase and subject to these Terms, we grant you a non-exclusive, non-transferable license to:

• Install and use the Software on one (1) website per license purchased
• Modify the Software for your own use, provided you do not redistribute modified versions
• Create derivative works for your own websites using the Software

This license is perpetual for the version purchased, subject to the restrictions and termination provisions outlined in these Terms.

3. Usage Restrictions

You may NOT:

• Redistribute, resell, lease, sublicense, or transfer the Software to any third party
• Remove or alter any proprietary notices, labels, or marks on the Software
• Use the Software to create a competing product or service
• Share your license key with others or use it on more than one website
• Reverse engineer, decompile, or disassemble the Software, except as permitted by applicable law
• Use the Software for any illegal purpose or in violation of any applicable laws

4. Payments and Refunds

Payment Terms

All prices are in US Dollars (USD) and are one-time payments unless otherwise specified. Payment processing is handled by Gumroad, our merchant of record. All applicable taxes are calculated and collected automatically.

Digital Products Policy

MadBot is a digital product. Due to the instant-delivery nature of digital goods, all sales are final and no refunds are provided as a standard policy.

We may consider refunds in exceptional circumstances, including:

• Critical product defects that cannot be resolved by our support team
• Accidental duplicate purchases

5. Support and Updates

Technical Support

Your license includes email-based technical support. Support is limited to:

• Installation and configuration assistance
• Bug reports and troubleshooting
• General usage questions

Support does not include customization services, third-party plugin conflicts, or server configuration issues beyond our control.

Software Updates

Your license includes one (1) year of software updates from the date of purchase. This includes:

• New features and improvements
• Bug fixes and security patches
• Compatibility updates for WordPress and PHP

After the update period expires, you may continue using the last version you received indefinitely. To continue receiving updates, you may renew for $49/year.

6. Intellectual Property

The Software, including all code, design, graphics, documentation, and other materials, is owned by TheMadRobot and is protected by copyright and other intellectual property laws.

Your purchase grants you a license to use the Software as specified in these Terms, but does not transfer any ownership rights to you.

Content you create using the Software (characters, conversations, etc.) remains your property, subject to any applicable third-party terms (e.g., AI provider terms of service).

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

• The Software will meet your specific requirements
• The Software will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Software will be accurate or reliable
• Any errors in the Software will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEMADROBOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.

9. Termination

Your license is effective until terminated. We may terminate your license immediately if you:

• Breach any provision of these Terms
• Violate the usage restrictions
• Engage in fraudulent or abusive behavior

Upon termination, you must cease all use of the Software and destroy all copies in your possession.

You may terminate your license at any time by ceasing to use the Software. Termination does not entitle you to a refund except as provided in Section 4.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website.

Your continued use of the Software after changes are posted constitutes your acceptance of the modified Terms.
